On 16 November 2020, the EU Commission has published its Technical Document on product claims for leave-on hydroalcoholic hand gels in the context of the COVID-19 pandemic, agreed by its Sub-Working Group on Borderline Products.
The document is a guidance, to be used and implemented by EU Member States authorities while carrying out individual assessments of cosmetic products; it complements the EU Commission Guidance on the applicable legislation for leave-on hand cleaners and hand disinfectants.
The Technical Document only applies to claims made for leave-on hydroalcoholic hand gels during the COVID-19 pandemic, which could be classed as cosmetics or biocides depending on their primary function, secondary claims and overall product presentation.
The guidance provides a negative list of claims, a negative list of reference or allusions and a negative list of pictures or graphical elements that cannot be used for cosmetic products.
